Facts
Marriage was declared irreparably broken down and thus dissolved by the trial court. The main issue was the division of the matrimonial house. Assessors and magistrate at the trial court had different views. In his determination, the District Court Magistrate accorded the award of the division of the house. Appellant aggrieved, appeals arguing non-participation on the part of the respondent in the construction of the house. 
Held: (i) The principle under the division of property under s.114 of Law of Marriage E Act is one of compensation. Whether what is being compensated is direct monetary contribution or domestic services, it does not matter. 
(ii) respondent's participation in clearing the site where the house was built amounted to her participation in its construction.

Appeal dismissed.
