I, KIMONGE ORIYO, Adult, Christian of sound mind DO HEREBY solemnly swear as

follows:-

1. That I am the applicant herein thus conversant with the facts I am about to depone to.

2. That on 29th October, 2004 the respondent attached my properties at NIC- LIFE HOUSE BUILDING in the alleged execution of court decree without issuing valid and or sufficient notice.

3. That there is still pending application no. 328/2002 at Regional Housing Tribunal between the Parties, and if execution will proceed, its outcome will be rendered nugatory.

4. That if the respondents, its agents, and or workmen are not restrained from evicting me forceful, I stand to suffer irreparable loss.

5. That all what is stated herein above in paragraph 1,2,3 and 4 is true to the best of my knowledge.
