 MEMORANDUM OF APPEAL

The above named Appellants being aggrieved by the findings and the decision of the trial tribunal appeals to this honourable court on points of law and facts as hereunder;

1. That, the trial tribunal erred in law to declare the respondent the legal owner of the disputed land while the evidence of the appellants was heavier than that of the respondent. 

2. That, the trial tribunal erred in law for failure to make proper analysis and evaluate of the evidence hence arrived at the erroneous decision which is not supported by the evidence on record.

3. That, the trial tribunal erred in law when it disregarded long history of the appellants’ ownership of the disputed land. 

4. That, trial tribunal erred in law and fact for failure to consider exhibits dated 16.6.1994 which has the strong information about the background of the disputed land and this exhibits tightly  shaky  the weight of the respondent’s evidence and testimonies.

WHEREFORE:- The Appellants  prays before this honorable court  hereunder:-

(a) To allow this Appeal with costs.

(b) Set aside the decision of the trial tribunal.

(c) Declare the appellants the legal owner of the disputed. land

(d) Any other relief this honorable court may think fit to grant.
