MEMORANDUM OF REVIEW

(Made under Order XLII Rule 1 and Section 95 of the CPC 1966 together with any

other enabling provisions of the law)

The Applicant herein above being aggrieved by the Order/ Ruling/ Decision of this honorable court delivered by Hon.Mutungi F.S.K on the 28th day of June2004 which vacated the interim order dated 30th day of April 2004 for stay of the decree of the Regional Housing Tribunal, Prays for review of the said Order/Ruling for the following grounds;

a) That this Honorable court erred in holding that the respondent omitted to file the Counter affidavit on the 2nd day of June 2004 as was so ordered while in fact the same was filed on the very date as it was ordered by this Honorable Court. A copy of the said Counter Affidavit and Receipt for filing fees is annexed hereto.

b) That this Honorable court erred in holding that the respondent lacked seriousness in the matter for not showing appearance while on the hearing date. In fact the hearing was scheduled to be held on 3rd of June 2004 at 1 PM, surprisingly the same was heard at 3 PM without notifying the respondent’s Advocate hence was denied an opportunity to be heard.

c) That this Honorable court erred in holding that the interim order dated 30th April, 2004 be vacated without taking into consideration the issue of security pursuant to the provisions of Order XXI Rule 24 (3) and Order XXXVII the CPC, 1966 only by the reason that the same is not mandatory.

WHEREFORE the applicant prays for the following orders;

1. That this Hon. Court Review and/ or reverse and set aside the decision dated 28th June,2004. and that the applicant/ respondent be given opportunity to be heard.

2. That the order dated 30th April 2004 be restored pending the determination of the Regional Housing Tribunal Application No.328 of 2002.
